Ballot Questions (directly copied from Maryland State Resolution)

(These ballot questions may be confusing, there will be a forum to explain and debate these issues at the Prince George's Civic Federation meeting on Oct. 7 at Largo High School.)

A RESOLUTION concerning
The Listing of Local Questions on the 2004 Ballot

For the purpose of designating the order and form in which local questions shall be placed on the 2004 ballot and matters related thereto.

WHEREAS, Section 7-103 (c)(3)(i) of the Election Law Article of the Annotated Code of Maryland provides that, unless some other process is mandated by law, the County Attorney shall designate the order and form in which local questions shall be placed on the ballot; and

WHEREAS, Section 1017 (c) of the Charter of Prince George’s County, Maryland provides that a resolution of the County Council has the force and effect of law of a temporary or administrative character; and

WHEREAS, it is the desire of the County Council to prescribe the form and order in which local questions shall be placed on the ballot;

NOW, THEREFORE, BE IT RESOLVED by the County Council of Prince George's County, Maryland, that the order and form of the questions shall be as follows:

QUESTION A
(CB-63-2004)
PUBLIC WORKS AND TRANSPORTATION FACILITIES BONDS
An Act enabling the County to borrow money and issue bonds in an amount not exceeding $55,900,000 to finance the design, construction, reconstruction, extension, acquisition, improvement, enlargement, alteration, renovation, relocation, rehabilitation or repair of Public Works and Transportation Facilities (including roads and bridges, parking lots, and maintenance facilities), as defined therein.

LIBRARY FACILITIES BONDS
An Act enabling the County to borrow money and issue bonds in an amount not exceeding $14,468,000 to finance the design, construction , reconstruction, extension, acquisition, improvement, enlargement, alteration, renovation, relocation, rehabilitation or repair of Library Facilities, as defined therein.

PUBLIC SAFETY FACILITIES BONDS
An Act enabling the County to borrow money and issue bonds in an amount not exceeding $9,476,000 to finance the design, construction, reconstruction, extension, acquisition, improvement, enlargement, alteration, renovation, relocation, rehabilitation or repair of Public Safety Facilities (including Fire Department Facilities), as defined therein.

COUNTY BUILDINGS BONDS
An Act enabling the County to borrow money and issue bonds in an amount not exceeding $11,780,000 to finance the design, construction, reconstruction, extension, acquisition, improvement, enlargement, alteration, renovation, relocation, rehabilitation or repair of County Buildings, as defined therein.

COMMUNITY COLLEGE FACILITIES BONDS
An Act enabling the County to borrow money and issue bonds in an amount not exceeding $5,290,000 to finance the design, construction, reconstruction, extension, acquisition, improvement, enlargement, alteration, renovation, relocation, rehabilitation or repair of Community College Facilities, as defined therein.

QUESTION F
(CB-55-2004)
PROPOSED CHARTER AMENDMENT
To provide that members of the County Council may not be elected to more than two consecutive terms; and to provide a precedence clause in the event of conflicting charter amendments ratified by the voters at the November 2004 general election.

QUESTION G
(CB-56-2004)
PROPOSED CHARTER AMENDMENT
To reaffirm the manner of election of the Chairman and Vice Chairman of the Council, and provide a precedence clause in the event of conflicting charter amendments ratified by the voters at the November 2004 general election.

QUESTION H
(By Petition)
PROPOSED CHARTER AMENDMENT
To enlarge the Council from nine to eleven members, adding two at-large members; providing that term limits on district members do not apply to a district member running for an at-large seat on the Council; providing that the at-large member receiving the greatest number of votes shall be Chairman of the Council.

PROPOSED CHARTER AMENDMENT
To establish voting rights for at-large council members and to provide a precedence clause in the event of conflicting Charter amendments ratified by the voters at the November 2004 general election.

QUESTION J
(CB-58-2004)
PROPOSED CHARTER AMENDMENT
To provide a limitation on the number of hours worked by persons in temporary or seasonal positions, and amend the provisions for action on the County classification plan.

BE IT FURTHER RESOLVED that the Legislative Officer of the County Council shall prepare and certify the above questions to the local board of elections in accordance with the provisions of Section 7-103 (b) of the Election Law Article of the Annotated Code of Maryland.

BE IT FURTHER RESOLVED that if any petition for Charter Amendment or for referendum is hereafter filed that meets all requirements of law, the Legislative Officer is hereby directed to prepare and certify said question to the local board of elections in accordance with the provisions of Section 7-103 (b) of the Election Law Article of the Annotated Code of Maryland.

BE IT FURTHER RESOLVED that in the event the petition reflected in Question H above fails to meet all requirements of law and is not placed on the ballot Questions F, G, H, and I, as designated above, are to be removed from the ballot for the November 2004 general election as they become abrogated by their terms or by operation of law, and Question J above shall be re-designated as Question F.

BE IT FURTHER RESOLVED that a copy of this Resolution shall be forwarded to the Board of Supervisors of Elections for Prince George’s County by the Clerk of the Council.
